The wording for clue 16d in Everyman crosswords 4096 and 4097 is exactly the same. In the case of 4096 the answer is given as "Guardian", which readily correlates with the clue, but in 4097 the answer is supposedly "Tortoise".
I would be grateful if someone can explain the 4097 answer, other than on the grounds of a compiler transcription error. Thanks in anticipation .

Tortoise are the new owners of the Observer. The timing of the two puzzles coincides with the transfer of ownership from the Guardian to Tortoise.
The clue, though worded identically can be solved in two ways.

I’m reminded of the parsing for TORTOISE.
It is TO IS in TORE (charged), with the definition relating to the fable of the tortoise and the hare.

Note also that ALOHA in 1d is the same in both puzzles.
ALOHA can mean both hello and goodbye.
So we have “Goodbye Guardian, Hello Tortoise”.

Thanks very much for your insights. I had also noted the repetition of 1d in both crosswords. However, as a follower of the crossword from New Zealand, I was not aware of the issues of the Observer ownership, which adds an unexpected extra layer of subtlety!
