Thanks, both. All finished now, though I still can't quite see how either 28 works. Definitions clear, as are both the "O(ver)" and the superfluous R in Across, and the superfluous "S" in Down; but beyond that I'm rather confused.

Hmmm...I have three clashing cells not two: 40a/24d, 38a/33d, 42a/26d

The 3-2-1 phrase that would seem to be apt violates the prohibition of the statement from the down letters in that it starts with the tabu letter.
