How can I be stuck on a three-letter word?

22a Without defendant in court, a recorder's initially seen to be disturbed. (7, 3)

A ? S ? N ? C ? / ? E ?

All I can think of is ABSENCE FEE .. but I can't see how it answers the clue.
Any suggestions?
