Assuming that I have interpreted your question correctly, a clue like:

4D. 10? Never. (10)

probably refers to another answer in the crossword. What's the answer to clue 10 and what letters do you have already in 4D?

I can't see an answer with these letters.
Could it be ROTTEN ?
ROT (never!) + TEN (10) = ROTTEN (ill).

Thanks Alchemist, I've revised my answer to 12 across giving me an E instead of an A and looks like rotten is what I'm looking for..
All this bother for a Tee shirt which, after correct entries for more years than I care to remember, I've yet to win !!
